It depends on whether the balcony, or the part that leaks, is common property or inside your own lot. An owners corporation must repair and maintain the common property. Where repairs benefit one or some lots only, the owners corporation can recover the cost from those lot owners.

Process

Do I need a registered builder for balcony waterproofing?

Victoria has a builder registration class limited to waterproofing. The Building and Plumbing Commission says registered builders are required for work worth more than A$10,000, and waterproofing is not on the regulations' list of single-trade contracts that sit outside the Act. Check the builder's photo ID card for the category of registration.

What does a leaking balcony look like?

The Commission's own signs are efflorescence, moving or cracked floor tiles, water marks on an exterior wall and ponding. Signs can show on the same floor as the balcony or on the level below. If you are worried about stability, avoid the area and restrict access.

Which registration covers an apartment balcony?

The regulator lists Class 2 under both registrations; check the builder's class. Check the builder's registration class and conditions against your building before signing.

Permits and approvals

Do I need a building permit to fix a leaking balcony?

Only sometimes. Repair, renewal or maintenance of part of an existing building needs no permit if it will not adversely affect structural soundness, uses like-for-like materials and will not affect public safety or an essential safety measure. Outside those conditions a permit is needed and the land owner must ensure one is in force. A planning permit or heritage overlay can still apply where no building permit is needed.
